What We Provide

TLC's Affordability & Hardship Assistant is a financial analysis tool that:

  • Analyzes your income, expenses, and debt obligations

  • Calculates your ability-to-pay using conservative algorithms

  • Generates personalized hardship assistance requests for creditors

  • Provides structured data and documentation for hardship programs

  • Offers allocation strategies across multiple lenders

What We Are NOT

  • Not a Credit Counseling Agency: We are not a registered credit counseling service

  • Not Financial Advisors: We do not provide personalized financial advice

  • Not Legal Counsel: We do not provide legal advice or representation

  • Not a Lender: We do not make loans or credit decisions

  • Not a Debt Settlement Company: We do not negotiate debts or settlements

 

3. User Responsibilities and Eligibility

Eligibility Requirements

  • Must be at least 18 years of age

  • Must have legal capacity to enter into agreements

  • Must provide accurate and complete information

  • Must be experiencing legitimate financial hardship

User Obligations

  • Accuracy: Provide truthful, complete, and current information

  • Documentation: Upload authentic financial documents only

  • Compliance: Follow all applicable laws and regulations

  • Good Faith: Use the Service for legitimate hardship assistance only

  • Communication: Respond promptly to verification requests

Prohibited Uses

  • Submitting false or fraudulent information

  • Using the Service to avoid legitimate debt obligations

  • Attempting to manipulate calculations or algorithms

  • Sharing account access with unauthorized parties

  • Using the Service for commercial purposes without permission

 

4. How the Service Works

Data Processing

  1. Upload: You provide financial documents (bank statements, pay stubs, etc.)

  2. Extraction: Our system extracts relevant income and expense data

  3. Analysis: We calculate your ability-to-pay using conservative algorithms

  4. Allocation: We distribute available funds across creditors by priority

  5. Generation: We create personalized hardship guidance for each lender

Conservative Calculations

  • Monthly net income from last 2 months of data

  • Essential expenses estimated conservatively when incomplete

  • Safety cushion of max($50, 5% of net income)

  • Policy caps: 20% of net (temporary hardship) or 15% (long-term)

  • Priority allocation: 60+/90 DPD accounts funded first

Output Formats

  • Machine-readable JSON with structured data

  • Hardship letters customized per lender

  • Audit trails showing calculations and assumptions

  • Missing data notifications for incomplete submissions

 

5. Disclaimers and Limitations

No Guarantees of Approval

  • We cannot guarantee lender approval of hardship requests

  • Each lender has their own criteria and decision-making process

  • Our calculations are estimates based on available information

  • Actual hardship program terms may vary from our suggestions

Information Accuracy

  • Our analysis is only as accurate as the information you provide

  • We make conservative estimates when data is incomplete

  • You are responsible for verifying all calculations and recommendations

  • We are not liable for decisions based on incomplete or inaccurate data

Not Financial Advice

  • Our Service provides tools and information, not advice

  • We do not recommend specific financial decisions or actions

6. Intellectual Property

7. Payment and Fees

No Hidden Costs

  • We do not charge fees to creditors or lenders

  • We do not receive commissions from hardship program approvals

  • Any third-party costs (credit reports, etc.) are clearly disclosed

  • We do not markup or profit from third-party services

8. Limitation of Liability

Maximum Liability

Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Excluded Damages

We are not liable for:

  • Indirect, incidental, or consequential damages

  • Lost profits, revenue, or business opportunities

  • Lender decisions regarding hardship requests

  • Reliance on Service outputs without independent verification

  • Technical failures or service interruptions

Financial Decisions

We are not responsible for:

  • Credit score impacts from your financial decisions

  • Lender responses to hardship requests

  • Changes in your financial situation after analysis

  • Third-party actions or decisions based on our reports

 

9. Indemnification

You agree to indemnify and hold harmless TLC and its employees, officers, and contractors from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service

  • Your violation of these Terms

  • Inaccurate information you provide

  • Your financial decisions or actions

  • Third-party claims related to your hardship requests

 

10. Third-Party Services

Integrations

We may integrate with third-party services for:

  • Credit reporting and analysis

  • Document processing and OCR

  • Secure file storage and transmission

  • Payment processing

Third-Party Terms

  • Each integration is governed by separate terms and privacy policies

  • You are responsible for reviewing and accepting third-party terms

  • We are not responsible for third-party service failures or policies

  • Integration availability may change without notice

12. Service Availability and Modifications

Availability

  • We strive for 99.5% uptime but cannot guarantee uninterrupted service

  • Scheduled maintenance will be announced in advance when possible

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

Assignment

We may assign these Terms without notice. You may not assign your rights without our written consent.

Waiver

Failure to enforce any provision does not constitute a waiver of that provision or any other.
